Terms of Service

Aikido Network — operated by MARTIAL ART NETWORK LLC, a Washington limited liability company

Effective date: 2026-09-16 Last updated: 2026-09-16

1. Agreement to these Terms

These Terms of Service ("Terms") are a binding contract between you and MARTIAL ART NETWORK LLC ("we," "us," "the Company"), which operates Aikido Network (the "Service") at aikido.network.

By creating an account, listing a dojo, registering for an event, submitting content, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

PLEASE READ SECTION 12 (ASSUMPTION OF RISK AND RELEASE), SECTION 14 (DISCLAIMERS), SECTION 15 (LIMITATION OF LIABILITY), AND SECTION 18 (ARBITRATION AND CLASS ACTION WAIVER) CAREFULLY. THEY LIMIT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE IN COURT AND TO PARTICIPATE IN A CLASS ACTION.

2. What the Service is — and what it is not

The Service is an online directory, communication, and registration platform for the aikido and martial arts community. It allows users to create profiles, list and find dojos and instructors, publish and read content, register for seminars, keiko, gasshuku, and other events, and communicate with one another.

We are a venue, not a party to your training. We do not:

  • operate, own, control, supervise, staff, or inspect any dojo, training hall, gym, or event venue;
  • teach, certify, license, rank, promote, grade, or supervise any instructor or student;
  • employ or contract with any instructor, sensei, dojo-cho, shihan, or event organizer listed on the Service;
  • verify the identity, qualifications, rank, dan or kyu grade, lineage, teaching credentials, insurance, first-aid training, criminal history, or fitness to teach of any person listed on or using the Service;
  • verify that any dojo or organizer carries liability insurance, complies with applicable law, or maintains any particular safety standard;
  • act as a sports governing body, national federation, certifying organization, or SafeSport-type authority; or
  • assume any duty to screen, vet, investigate, background-check, monitor, or supervise any user, instructor, dojo, organizer, or event.

Any training you attend is a relationship between you and the dojo, instructor, or organizer — not with us. You are solely responsible for evaluating any dojo, instructor, event, or training partner before you train, and for satisfying yourself as to their qualifications, safety practices, insurance, and suitability for you.

3. No affiliation or endorsement

Aikido Network is an independent service. We are not affiliated with, endorsed by, sponsored by, or authorized by the Aikikai Foundation / Aikido World Headquarters (Hombu Dojo), the International Aikido Federation, the United States Aikido Federation, Aikido Schools of Ueshiba, the Ki Society, Yoshinkan Aikido, Birankai, the Iwama / Shinshin Aikishuren Kai, or any other aikido or martial arts organization, federation, style, or ryuha, unless we expressly state otherwise in writing.

All organization names, style names, dojo names, mon, kamon, logos, and other marks appearing on the Service are the property of their respective owners and are used for identification and descriptive purposes only. Their appearance does not imply any affiliation, sponsorship, or endorsement in either direction.

4. Eligibility, accounts, and minors

4.1 Minimum age

You must be at least 18 years old to create an account for yourself. You must provide accurate information and keep it current. You are responsible for all activity under your account and for keeping your credentials secure. Notify us immediately at security@aikido.network of any unauthorized use.

4.2 We do not operate a parental-consent flow

We do not currently offer a verifiable parental consent mechanism, linked parent and child accounts, or any feature designed for use by children. We ask for a date of birth at sign-up in order to turn away applicants below the minimum age, and we do not retain it.

If we learn that we hold personal information from a child below the minimum age, we delete it. A parent or guardian who believes we hold information about their child should contact privacy@aikido.network.

4.3 Dojo-submitted information about minors

A dojo, instructor, or organizer who uploads or enters information about a person under 18 — for example a class roster, rank record, attendance record, or event registration — represents and warrants that it has obtained all consents required by law from that person's parent or legal guardian, including any consent required for disclosure to us and for our processing on the dojo's behalf, and that it will provide us with evidence of that consent on request. That dojo, instructor, or organizer indemnifies us under Section 16 for any breach of this representation.

Nothing in these Terms purports to waive, release, or limit any claim belonging to a minor. Under Washington law a parent or guardian generally cannot release a minor child's future claim for personal injury caused by negligence, and Section 12 does not attempt to do so.

4.4 Suspension and termination

We may suspend or terminate any account, remove any listing, or remove any content, at any time, with or without notice, for any reason or no reason, including where we believe in good faith that doing so protects the safety of users or the integrity of the Service. We are not liable to you for doing so. Sections that by their nature should survive termination do survive.

5. User content

5.1 Your content and your license to us

"User Content" means anything you submit, post, or upload: profile information, dojo and event listings, articles, technique notes, comments, messages, photographs, video, audio, and rank or training records.

You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (for formatting and technical purposes), publish, publicly display, publicly perform, and distribute your User Content for the purpose of operating, promoting, and improving the Service. This license ends when you delete the content, except for (a) copies retained in backups for a commercially reasonable period, (b) content others have shared or reposted, and (c) content we must retain to comply with law.

5.2 Your representations

You represent and warrant that, for each item of User Content:

  • you own it or have all necessary rights to grant the license above;
  • it does not infringe any copyright, trademark, trade secret, moral right, right of privacy, or right of publicity (including under RCW 63.60, Washington's Personality Rights Act);
  • for any photograph, video, or audio recording of a person other than yourself, you have obtained that person's consent — and, where the person is under 18, the consent of their parent or legal guardian — to record them and to publish the recording on the Service;
  • it is not defamatory, and any factual statement you make about an identifiable person or dojo is true to the best of your knowledge; and
  • it complies with these Terms and applicable law.

5.3 Rank, grade, lineage, and credential claims

All rank, grade, dan/kyu level, title (sensei, shidoin, fukushidoin, shihan), certification, lineage, affiliation, and teaching-credential information on the Service is self-reported by users or submitted by dojos and organizations. We do not verify it.

You agree that:

  • any rank or credential you publish is accurate and was conferred by the organization you identify;
  • you will not claim a rank, title, certification, teaching authority, or lineage you have not been awarded, and will not imply affiliation with an organization that has not affiliated you;
  • records displayed on the Service are not official certificates, and are not a substitute for the records of the awarding organization; and
  • we have no obligation to adjudicate disputes about rank, lineage, affiliation, or legitimacy, and any action or inaction we take on such a dispute is at our sole discretion.

We may remove, correct, label, or refuse to display any credential claim. We are not liable for any loss arising from the accuracy, inaccuracy, presence, absence, alteration, or deletion of any rank or training record on the Service, and you should maintain your own copies of your certificates and records.

5.4 Prohibited conduct

You will not:

  • misrepresent your identity, rank, credentials, or affiliation, or impersonate any person, dojo, or organization;
  • post content that is unlawful, defamatory, harassing, threatening, hateful, sexually explicit, or that sexualizes or endangers a minor;
  • publish an intimate visual depiction of an identifiable person — real, digitally created, or altered — without that person's consent (see Section 13.1);
  • solicit, contact, or attempt to arrange private contact with a minor other than through features we provide for that purpose;
  • post another person's private information (address, phone number, government ID, financial information, health information) without consent;
  • post instructional content that describes how to inflict serious injury outside a legitimate training context, or that encourages unsafe practice;
  • scrape, crawl, harvest, or bulk-download the directory or any user data except as we expressly permit in writing;
  • use the Service to build or train a competing directory, dataset, or machine-learning model;
  • interfere with, probe, or attempt to gain unauthorized access to the Service; or
  • use the Service in violation of any applicable law, including export and sanctions law.

5.5 Moderation — our right, not our duty

We may — but have no obligation to — review, monitor, edit, label, demote, or remove User Content. We are not the author or publisher of User Content and do not endorse it. Our decision to moderate some content does not create any duty to moderate other content. We are entitled to the protections of 47 U.S.C. § 230 for content provided by others, and nothing in these Terms waives that.

5.6 Commentary about identifiable people

Anything a user writes about a dojo, an instructor, or another person — in a listing, an article, a message, or a shared document — is that user's own statement. We do not investigate, verify, or endorse it.

If you believe content about you is false, defamatory, or violates these Terms, send a notice to legal@aikido.network identifying the content, the specific statements at issue, and why they are false or violating. We will review it and may remove, retain, annotate, or take no action, at our sole discretion.

Serious allegations of misconduct, abuse, or harm should be reported to law enforcement and to the relevant governing organization, not only to us. We are not an investigative body, we cannot adjudicate such allegations, and we do not represent that any listing is safe.

6. Dojo and instructor listings

6.1 Listing accuracy and claiming

Anyone may submit a listing. If you claim or manage a listing, you represent that you are authorized to act for that dojo or organization, and that the listing is accurate and kept current.

We may create, edit, merge, split, relocate, unpublish, or delete listings, including listings compiled from public sources, at our sole discretion. We do not guarantee that any listing is accurate, current, complete, authorized, or that the dojo exists or is operating.

6.2 Removal requests

A dojo may request removal of its listing by contacting legal@aikido.network from a verifiable address. We will act on legitimate requests within a reasonable time. Removal does not delete User Content that others independently posted about the dojo.

6.3 No endorsement, no ranking guarantee

Placement, ordering, search results, featured status, and any badge or label on the Service are determined by us and may reflect paid placement, recency, or other factors. Placement is not an endorsement, a safety rating, or a statement of quality or qualification. Where a listing or placement is paid, we will identify it as such.

7. Events, seminars, and in-person training

7.1 Registration is with the organizer

When you register for an event, seminar, gasshuku, camp, class, or grading through the Service, your contract is with the organizer or host dojo, not with us. We provide the registration and payment tooling. We are not the organizer, promoter, host, sponsor, or insurer of any event.

7.2 Organizer obligations

If you use the Service to publish or take registrations for an event, you represent, warrant, and agree that you:

  • have the authority and any required licenses or permits to hold the event;
  • will comply with all applicable law, including health, safety, accessibility, and minor-protection law;
  • maintain general liability insurance appropriate to martial arts instruction, in amounts customary for your activity and jurisdiction, naming coverage for participant bodily injury;
  • will obtain your own participant agreements, waivers, medical-information forms, and — for participants under 18 — parent/guardian consents and any required background screening, directly from participants, and will not rely on these Terms or on us for that purpose;
  • have qualified supervision, a first-aid plan, and an emergency response plan appropriate to the activity;
  • will accurately describe the event, its intensity level, prerequisites, rank requirements, weapons use, and any restrictions; and
  • will honor the refund and cancellation policy you publish.

You indemnify us under Section 16 for all claims arising out of your event.

7.3 Cancellation and refunds

The organizer sets and is responsible for the refund and cancellation policy for their event; it is displayed at registration. We do not guarantee refunds and are not responsible for an organizer's failure to hold an event or to refund you.

7.4 Your fitness to participate

You are solely responsible for determining whether you are physically and medically fit to participate in any training. You should consult a physician before beginning or resuming martial arts training. You will disclose to the organizer or instructor any condition, injury, limitation, medication, or pregnancy relevant to your safety before training. Do not send health information to us; send it to the organizer.

8. Payments, fees, and subscriptions

8.1 Processing

Payments are processed by Stripe, subject to its terms. We do not store full payment card numbers. You authorize us and our processor to charge your selected payment method for amounts you owe.

8.2 Dojo payments run through the dojo's own Stripe account

When a dojo collects membership dues, event fees, or other payments from its members through the Service, it does so through its own Stripe Connect account. The dojo is the merchant of record for those payments. Funds are paid to the dojo's account; we deduct a disclosed platform fee and do not hold or remit the dojo's money ourselves.

This means the dojo — not us — is responsible for the price, the goods or services, the refund policy, tax, and any dispute about the transaction.

8.3 We do not charge for the Service today

Aikido Network is currently free to use. The payments described in §8.2 are between a dojo and its members; we do not bill you for an Aikido Network subscription.

When we introduce paid plans we will give you at least 30 days' notice under Section 19, and Section 8.4 will apply from that point. We will not move an existing account onto a paid plan without your agreement.

8.4 Paid plans, when they arrive

Paid plans will begin with a 30-day free trial. You will not be charged during the trial, and we will email you before it ends.

  • We will clearly and conspicuously disclose, before you provide billing information: what you are subscribing to, the price, the billing frequency, the renewal terms, the deadline to cancel to avoid the next charge, and how to cancel.
  • Your subscription will renew automatically at the then-current price for successive terms until you cancel.
  • You may cancel at any time from your dojo's billing settings, without speaking to anyone and without any retention step you cannot skip. Cancellation takes effect at the end of the current billing period.
  • We will send a reminder before a free trial converts to a paid subscription, and notice of any price change or material term change before it takes effect.
  • Subscription fees are non-refundable except where required by law. If you cancel, your plan stays active until the end of the period you have paid for, and you are not charged again.

8.5 Taxes and chargebacks

You are responsible for applicable taxes other than taxes on our income. If you initiate a chargeback, we may suspend your account pending resolution and may recover from you the disputed amount plus processor fees where the chargeback is determined to be invalid.

9. Communications

You consent to receive service-related communications electronically. Marketing email includes an unsubscribe link; we send marketing email only to users who have opted in, and the subject line and sender information will accurately describe the message and its commercial nature.

We do not send SMS or text messages. If that changes, separate consent and opt-out terms will apply and we will tell you before it does.

Washington requires the consent of all parties to record a private conversation or communication (RCW 9.73.030). Do not record calls, video meetings, or conversations through or about the Service without the consent of all parties.

10. Privacy

Our Privacy Policy explains what we collect and how we use it, and is incorporated into these Terms.

Health-related information. We do not want and ask you not to send us information about your or anyone else's medical conditions, injuries, treatment, or health status. Medical clearances, injury reports, and health questionnaires belong with your dojo or event organizer, not with us.

11. Intellectual property

The Service, including its software, design, text, graphics, and our marks, is owned by us and protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, reverse engineer, or create derivative works of the Service.

DMCA. If you believe content on the Service infringes your copyright, send a notice with all elements required by 17 U.S.C. § 512(c)(3) to our designated agent: MARTIAL ART NETWORK LLC, Attn: DMCA Agent, 4129 M L King Jr Way S., Seattle, WA 98108, legal@aikido.network. We will respond to valid notices and counter-notices and will terminate repeat infringers in appropriate circumstances.

12. Assumption of risk and release — ADULTS

THIS SECTION APPLIES ONLY TO USERS 18 AND OVER, ACTING FOR THEMSELVES. IT DOES NOT APPLY TO, AND DOES NOT PURPORT TO RELEASE, ANY CLAIM OF A PERSON UNDER 18.

ASSUMPTION OF RISK

AIKIDO AND OTHER MARTIAL ARTS ARE PHYSICALLY DEMANDING ACTIVITIES THAT INVOLVE AN INHERENT AND SIGNIFICANT RISK OF INJURY OR DEATH. THOSE RISKS INCLUDE, WITHOUT LIMITATION:

  • falls and breakfalls (ukemi), including high falls, and impact with mats, floors, walls, and other people;
  • joint manipulation and locks (including ikkyo, nikyo, sankyo, yonkyo, kotegaeshi, and shihonage), which can cause sprains, dislocations, ligament and tendon damage, and fractures;
  • throws, pins, and restraint techniques;
  • strikes (atemi), grabs, and collisions with training partners;
  • choking, strangulation, and restriction of breathing in styles that practice them;
  • training with weapons, including bokken, jo, tanto, and live blades;
  • concussion and other head, neck, and spine injury;
  • injury caused by the negligence, inexperience, fatigue, aggression, or misconduct of an instructor or training partner;
  • cardiac events, heat illness, and aggravation of pre-existing conditions;
  • unsafe premises, equipment, or mats; and
  • injury during travel to and from training.

YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL SUCH RISKS, WHETHER OR NOT DESCRIBED ABOVE AND WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF ANY PERSON.

RELEASE

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE, WAIVE, AND DISCHARGE MARTIAL ART NETWORK LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS FROM ALL CLAIMS, DEMANDS, LOSSES, AND CAUSES OF ACTION OF ANY KIND — INCLUDING CLAIMS BASED ON OUR OWN ORDINARY NEGLIGENCE — ARISING OUT OF OR RELATING TO:

  1. ANY TRAINING, CLASS, SEMINAR, GRADING, DEMONSTRATION, OR EVENT YOU LEARNED OF, FOUND, OR REGISTERED FOR THROUGH THE SERVICE;
  2. THE ACTS OR OMISSIONS OF ANY DOJO, INSTRUCTOR, ORGANIZER, TRAINING PARTNER, OR OTHER USER; AND
  3. ANY INTERACTION OR MEETING BETWEEN USERS, ONLINE OR IN PERSON.

THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, WILLFUL OR WANTON MISCONDUCT, OR INTENTIONAL WRONGDOING BY US, OR TO ANY LIABILITY THAT CANNOT BE RELEASED UNDER APPLICABLE LAW.

YOU HAVE READ THIS SECTION, YOU UNDERSTAND THAT YOU ARE GIVING UP SUBSTANTIAL LEGAL RIGHTS INCLUDING THE RIGHT TO SUE, AND YOU AGREE TO IT FREELY.

FOR PARENTS AND GUARDIANS. If you are a parent or legal guardian and you accept these Terms in connection with a minor's participation in training you found through the Service, you release your own claims — including derivative claims such as medical expenses and loss of consortium arising from injury to the minor — on the terms above. You do not, and cannot, release the minor's own claims, and nothing here attempts to.

13. Safety, misconduct, and emergencies

  • Emergencies. The Service is not a safety, monitoring, or emergency service. If someone is in danger, call 911 or your local emergency number. Do not use the Service to report an emergency.
  • Reporting. You may report abuse, harassment, misconduct, or safety concerns to legal@aikido.network. We will review reports and may take action, but we do not promise any particular outcome or timeline, and we may be legally required to report certain matters to authorities.
  • Mandatory reporting. Where we have information suggesting risk to a child, we may report it to law enforcement or the National Center for Missing & Exploited Children, and we may preserve and disclose related data without notice to you.
  • No screening. We repeat, because it matters: we do not conduct background checks or screening of any user, instructor, dojo, or organizer. Do not rely on the Service as a safety signal. Verify credentials directly with the awarding organization, and satisfy yourself independently before training with anyone or allowing a young person in your care to do so.

13.1 Nonconsensual intimate imagery — notice and removal

Publishing an intimate visual depiction of an identifiable person without their consent, including a digitally created or altered depiction, is prohibited and is a violation of federal law.

If an intimate visual depiction of you has been published on the Service without your consent, you may request its removal at privacy@aikido.network, or through the form at https://aikido.network/report/intimate-image. You do not need an account to make a request. Provide: (a) a physical or electronic signature; (b) identification of the depiction and information reasonably sufficient to locate it; (c) a brief statement that you did not consent to its publication; and (d) contact information.

We will remove the reported depiction, and any known identical copies, within 48 hours of receiving a valid request, and will make reasonable efforts to identify and remove identical copies.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; ANY LISTING, RANK, CREDENTIAL, REVIEW, OR OTHER CONTENT IS ACCURATE OR TRUE; ANY USER IS WHO THEY CLAIM TO BE; ANY DOJO, INSTRUCTOR, OR EVENT IS SAFE, QUALIFIED, INSURED, OR SUITABLE; OR THAT DATA WILL NOT BE LOST. WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, ONLINE OR OFFLINE.

NOTHING ON THE SERVICE IS MEDICAL, LEGAL, OR PROFESSIONAL ADVICE.

Some jurisdictions do not allow certain warranty exclusions, so parts of this Section may not apply to you.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

(a) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST GOODWILL, BUSINESS INTERRUPTION, OR THE COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.

(b) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS ($100).

(c) THESE LIMITS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

(d) THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING, WHERE APPLICABLE, GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY OUR OWN NEGLIGENCE IN JURISDICTIONS THAT PROHIBIT SUCH LIMITATION.

These limits are a fundamental basis of the bargain and reflect the fact that we provide the Service at low or no cost.

16. Indemnification

You will defend, indemnify, and hold harmless MARTIAL ART NETWORK LLC and its members, managers, officers, employees, contractors, and agents from and against all claims, damages, losses, liabilities, judgments, settlements, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • your use of the Service;
  • your User Content, including any claim of defamation, infringement, or violation of privacy or publicity rights;
  • any dojo listing, credential claim, or event you publish;
  • any event you organize or class you teach, including any injury to a participant;
  • your breach of these Terms or of any law; or
  • your interactions with any other user, including any in-person meeting or training.

We may assume exclusive defense and control of any matter subject to indemnification by you, at your expense, and you will cooperate.

Nothing in this Section requires a parent or guardian to indemnify us against a minor's own claim for personal injury.

17. Governing law and venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws rules. Subject to Section 18, the exclusive venue for any dispute is the state and federal courts located in King County, Washington, and you consent to personal jurisdiction there.

18. Dispute resolution — arbitration and class action waiver

PLEASE READ. THIS SECTION AFFECTS HOW DISPUTES WITH US ARE RESOLVED.

18.1 Informal resolution first. Before filing any claim, you agree to contact us at legal@aikido.network with a written description of the dispute and the relief sought, and to negotiate in good faith for 60 days.

18.2 Binding arbitration. If we cannot resolve it, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before one arbitrator, seated in King County, Washington, or by videoconference at your election. The Federal Arbitration Act governs. The arbitrator decides all issues except that a court decides the enforceability of Section 18.3.

We pay the arbitration fees that the AAA Consumer Arbitration Rules allocate to us, and we will not seek our attorneys' fees from you unless the arbitrator finds your claim frivolous.

18.2.1 Multiple similar claims. Where 25 or more claims of a similar nature are filed against us by or with the assistance of the same counsel, they will be administered under AAA's Mass Arbitration Supplementary Rules. The parties will select an initial group of no more than 10 claims to proceed as bellwethers; the remaining claims are stayed, and the limitations period on them is tolled, until those conclude. The parties will then attempt to resolve the remaining claims using what the bellwethers decided, and any that remain proceed in further batches on the same basis.

18.3 CLASS ACTION WAIVER. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY FORM OF REPRESENTATIVE PROCEEDING. If this paragraph is found unenforceable as to a particular claim, that claim proceeds in court and the rest of Section 18 still applies to all other claims.

18.4 Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property or for unauthorized access to the Service.

18.5 Opt-out. You may opt out of arbitration and the class action waiver by emailing legal@aikido.network within 30 days of first accepting these Terms, stating your name, the email on your account, and that you opt out. Opting out does not affect any other part of these Terms.

18.6 Time limit. To the extent permitted by law, any claim must be brought within one (1) year after it arises, or it is permanently barred.

19. Changes to these Terms

We may modify these Terms. We will post the updated Terms with a new "Last updated" date and, for material changes, give at least 30 days' notice by email or in-product notice before they take effect. Material changes to Section 18 (Arbitration) will not apply retroactively to disputes of which we have notice. Continuing to use the Service after the effective date means you accept the updated Terms. If you do not accept, stop using the Service and cancel any subscription.

20. General

  • Entire agreement. These Terms, the Privacy Policy, and any additional terms you accept for a specific feature are the entire agreement between us.
  • Severability. If a provision is unenforceable, it is modified to the minimum extent necessary or severed, and the rest remains in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control.
  • No third-party beneficiaries, except that the released and indemnified parties in Sections 12, 15, and 16 may enforce those Sections.
  • Notices to us: legal@aikido.network and 4129 M L King Jr Way S., Seattle, WA 98108. Notices to you: the email on your account.
  • Headings are for convenience only.
  • Users outside the United States. The Service is operated from the United States. If you access it from elsewhere, you do so on your own initiative and are responsible for compliance with local law, and you consent to the transfer and processing of your information in the United States. Our Privacy Policy describes the rights available to users in the EU, the UK, and other regions.
